Returns and refunds

This page explains when a part can be sent back, who pays for it, and what happens if it arrives faulty or does not match the order. The rules are not the same for consumers and for business customers — read the column that applies to you.

Which rules apply to you

A consumer is a natural person buying for purposes outside their trade, business, craft or profession. Everyone else — companies, sole traders, farms and other organisations buying for their activity — is a business customer. The distinction is set by Article 2 of Directive 2011/83/EU, not by us, and it decides which of the two columns below applies to you. Buying in a company name, or giving a VAT number at checkout, means you are buying as a business.

Consumers (private individuals)

At a glance:

  • 14 days to cancel any purchase, no reason needed.
  • You pay the cost of sending the goods back.
  • We refund the price plus the standard outbound delivery cost.
  • If the part has lost value because you did more than inspect it, we deduct that loss — we do not refuse the return.
  • Two-year statutory warranty for faults.

Business customers (B2B)

At a glance:

  • No right to cancel — the 14-day right is a consumer right and does not apply to business purchases.
  • Returns only by prior written agreement with us.
  • Accepted only in the original, undamaged packaging.
  • Fitted parts, and parts whose original packaging has been destroyed, are not accepted back.
  • 12-month contractual warranty for faults.

Consumers: the 14-day right to cancel

If you are a consumer, you may cancel your purchase within 14 days of the day you (or a carrier you nominated) take physical possession of the goods. You do not have to give a reason.

To cancel, send us a clear statement by e-mail to info@techspares.eu before the 14 days expire. It helps if you include your order number. Sending the message on the last day is enough — it does not have to reach us earlier.

Sending the item back

  • Send the goods back within 14 days of telling us you cancel.
  • Contact us first so we can confirm the return address and, where the part is heavy, agree on how it should be packed.
  • You bear the direct cost of returning the goods. Many of our parts weigh 20 kg or more, so check the carrier price before you ship.
  • Pack the part so it arrives undamaged. Damage caused by inadequate packing is a loss in value and is deducted.

Refund

We refund all payments received from you, including the standard outbound delivery cost, within 14 days of the day we receive the goods back or you provide proof that you sent them, whichever is earlier. We refund using the same means of payment you used, unless you agree otherwise. If you chose a delivery option more expensive than our cheapest standard one, we refund the standard cost only.

Loss in value — what we may deduct

You may handle and inspect the part as you would in a shop: unpack it, look at it, compare the numbers, check that it is the right item. If you go beyond that and the goods lose value as a result, we deduct that loss from your refund. This is Article 14(2) of Directive 2011/83/EU, and it applies in particular where the part has been:

  • fitted to a machine;
  • started or run, so that oil, fuel, coolant or refrigerant has passed through it;
  • painted;
  • machined or modified — drilled, cut, re-threaded, pressed;
  • stripped of its protective plugs, caps or seals;
  • taken out of an original packaging that has been destroyed or thrown away.

The deduction reflects what the part is still worth to us. A spare part that can no longer be sold as new is often worth very little, and in that case the deduction can reach the full price of the goods. We always tell you the amount and the reason before we make the refund, and you may ask us to send the part back to you instead, at your cost.

Exceptions to the 14-day right

The right to cancel does not apply to goods made to your specification or clearly personalised. It does not apply to business purchases. Your statutory rights in respect of faulty goods are unaffected by any of the above.

Model withdrawal form

You do not have to use this form. Any unambiguous statement that you wish to withdraw, sent before the 14 days end, is enough. We provide the form because we must; using it is your choice.

(complete and return this form only if you wish to withdraw from the contract)

Business customers: returns

A business purchase is final when the contract is concluded. There is no cooling-off period: the 14-day right in Directive 2011/83/EU is granted to consumers only, and it does not extend to companies, sole traders or farms buying for their activity.

We may nevertheless agree to take an item back as a commercial gesture. If we do, all of the following apply:

  • The return must be agreed with us in writing before anything is shipped. Parcels sent back without prior agreement are refused.
  • The part must be in its original, undamaged packaging, complete with all plugs, caps, seals and documents.
  • A part that has been fitted, or whose original packaging has been destroyed, is not accepted back. This condition applies to business customers in full, without deduction as an alternative.
  • You pay the shipping in both directions — on business purchases the outbound cost is not refunded.
  • We may apply a restocking charge, which we tell you before you ship.

Faulty or incorrect parts

This is separate from cancellation and applies to both groups: if a part is defective, damaged in transit, or is not what you ordered, contact us with the order number and photographs. Where the fault is ours or the manufacturer’s, we pay the return shipping and either replace the part or refund you in full.

Consumers (private individuals)

  • Two years from delivery — the statutory EU warranty for lack of conformity.
  • Not limited to 14 days and not affected by the cancellation rules above.

Business customers (B2B)

  • 12 months from delivery — our contractual warranty for business purchases.
  • Report a visible transport defect within 7 days of receipt, so that a claim against the carrier is still possible.

Wear parts consumed in normal use, and damage caused by incorrect fitting, overloading, contamination or use outside the manufacturer’s specification, are not covered by either warranty.

Where to send returns

Unless we give you a different address in writing, returns go to our registered office: JESPE, MB, Vėjo g. 12-2, Ginduliai, LT-91276 Klaipėda district, Lithuania. Always contact us first — see Company details.

Complaints

Write to us first at info@techspares.eu — most issues are settled directly. If we cannot agree, a consumer resident in Lithuania may apply to the State Consumer Rights Protection Authority (Valstybinė vartotojų teisių apsaugos tarnyba, vvtat.lt). A consumer resident in another EU country may contact the European Consumer Centre in their own country. Business disputes are settled under the Terms and conditions.
