Terms and conditions

These terms govern purchases made through techspares.eu. By placing an order you accept them. They do not limit any right you have as a consumer under mandatory EU or national law.

1. The seller

2. Who these terms apply to

A consumer is a natural person buying for purposes outside their trade, business, craft or profession. Everyone else — companies, sole traders, farms and other organisations buying for their activity — is a business customer. The distinction is set by Article 2 of Directive 2011/83/EU, not by us, and it decides which of the two columns below applies to you. Buying in a company name, or giving a VAT number at checkout, means you are buying as a business.

Where a clause below is marked as applying to consumers or to business customers, it applies only to that group. Everything else applies to both.

3. Products

We sell new spare parts for agricultural and construction machinery. Product pages list the part number, the numbers the part replaces and the machines it is listed for. Those lists come from manufacturer and distributor data and are an aid to identification, not a guarantee of fitment for your particular machine — if you are unsure, write to us before ordering and we will check.

Photographs are illustrative. The manufacturer and product safety information required by Regulation (EU) 2023/988 is shown in a dedicated section on every product page.

4. Prices

All prices are in euro (EUR). The total payable, including any applicable VAT and the shipping cost, is shown before you confirm the order. We reserve the right to change prices at any time; the price that applies is the one shown when you place your order.

5. Orders and availability

Your order is an offer to buy. The contract is formed when we confirm the order by e-mail. If an item turns out to be unavailable after your order, we will tell you and refund the amount paid for that item in full. We do not substitute a different part without your agreement.

6. Payment

Payment is made at the time of ordering, using one of the methods shown at checkout. Goods are dispatched after the payment has been received.

7. Dispatch and delivery

We dispatch within 1–4 business days of payment. The exact dispatch date is shown at checkout.

We do not promise a delivery date. Transit time depends on the carrier and the service selected at checkout. We ship across the European Union; for other countries we agree the price with you before you order. The delivery cost and the carrier are shown at checkout before you confirm. The shipping cost is paid by the customer in both directions, subject to clause 8 — with the one exception that where a consumer validly cancels, we refund the standard outbound cost, as Article 13(1) of Directive 2011/83/EU requires. For business purchases the rule applies in both directions without exception. Risk of loss or damage passes to you when you, or a carrier you nominated yourself, take physical possession of the goods. Full details are on the Delivery page.

Some parts weigh more than 30 kg and cannot travel as a standard parcel. Where that applies, it is stated on the product page and reflected in the shipping options.

8. Cancellation and returns

Consumers (private individuals)

  • A 14-day right to cancel, counted from delivery, with no reason required.
  • You bear the direct cost of returning the goods; we refund the price and the standard outbound delivery cost.
  • We may deduct any loss in value caused by handling the goods beyond what is needed to establish their nature, characteristics and functioning — up to the full price where the part can no longer be sold.

Business customers (B2B)

  • No right to cancel. A business purchase is final once the contract is concluded.
  • Returns only by prior written agreement, in the original undamaged packaging; fitted parts and parts with destroyed packaging are not accepted.
  • Shipping in both directions is at your cost; a restocking charge may apply.

9. Warranty

Consumers (private individuals)

  • Two years from delivery — the statutory EU warranty for lack of conformity.

Business customers (B2B)

  • 12 months from delivery — our contractual warranty for business purchases.
  • Visible transport damage must be reported within 7 days of receipt.

Neither warranty covers wear parts consumed in normal use, or damage caused by incorrect fitting, overloading, contamination or use outside the manufacturer’s specification. Where a fault is ours or the manufacturer’s, we pay the return shipping and either replace the part or refund it.

10. Liability

We are liable for foreseeable loss caused by our breach of these terms. We are not liable for loss of profit, loss of use or downtime of machinery, except where such exclusion is not permitted by law. For business customers, our total liability for any one order is limited to the price paid for that order. Nothing here limits liability for death or personal injury caused by our negligence, or for fraud.

12. Governing law and disputes

These terms are governed by the law of the Republic of Lithuania. If you are a consumer, this does not deprive you of the protection of the mandatory rules of the country where you live.

Please contact us first at info@techspares.eu. If we cannot settle the matter, a consumer resident in Lithuania may apply to the State Consumer Rights Protection Authority (vvtat.lt); a consumer resident elsewhere in the EU may contact the European Consumer Centre in their own country. Disputes with business customers are settled by the competent courts of the Republic of Lithuania.
